Welcome to Burky Swim. These Terms & Conditions ("Terms") govern your use of our website located at www.burkyswim.com (the "Site") and the purchase of our products. By accessing the Site or placing an order, you agree to be bound by these Terms.

 

1. BUSINESS IDENTITY

The Site is operated by Burak Serpen trading as Burky Swim, a company registered and established in Bursa, Turkey.

2. ELIGIBILITY

By using this Site or placing an order, you represent that you are at least the age of majority in your country, state, or province of residence, and you have given us your consent to allow any of your minor dependents to use this Site.

 

3. PRODUCTS AND MANUFACTURING

  • Manufacturing: Burky Swim products are designed with precision and manufactured using high-quality sewing and machine-stitching techniques. We focus on durability, fit, and the integrity of our signature hardware.

  • Display: We strive to display product colors and the gold-toned buckle details as accurately as possible. However, actual colors may vary slightly depending on your screen settings.

 

4. PRICING

  • Base Currency: All product prices displayed on our Site, as well as all checkout transactions and settlements, are denominated in United States Dollars (USD).

  • International Cards: If your bank account or credit card is issued in a currency other than USD (for example EUR, GBP, or CAD), your bank or card issuer may automatically convert the transaction amount using its own exchange rate and may apply foreign transaction or conversion fees. Burky Swim is not responsible for exchange-rate differences or fees charged by your financial institution.

  • Taxes & Shipping (USA, EU & UK): For orders delivered within the United States (USA), the European Union (EU), and the United Kingdom (UK), applicable VAT and/or import duties are fully covered under our DDP policy. Product prices displayed on the Site do not include shipping. The applicable shipping fee is calculated based on the delivery destination and added to the order total at checkout before payment.

5. INTERNATIONAL DUTIES & TAXES (DDP & DDU POLICY)

Burky Swim provides a premium delivery experience by covering customs formalities for our primary markets.

  • DDP (Delivered Duty Paid): For orders shipped to the United States (USA), the European Union (EU), and the United Kingdom (UK), we operate on a DDP basis. All applicable cross-border duties, taxes, and VAT are prepaid by Burky Swim, so you will not be charged additional customs duties or import taxes upon delivery. DDP coverage does not include the shipping fee; shipping is calculated separately based on the destination and added to your order total at checkout.

  • DDU (Delivered Duty Unpaid): Orders shipped to Brazil, Peru, Philippines, South Africa, and all other destinations not explicitly covered under DDP, are shipped on a DDU (Delivered Duty Unpaid) basis. All import duties, customs fees, local taxes, and clearance charges levied by the destination country's authorities are the sole responsibility of the Buyer. If a package is refused, abandoned, or returned due to the Buyer's failure to pay these local customs charges, all original shipping costs, return shipping fees, and any customs penalties incurred by Burky Swim will be directly deducted from the Buyer's final refund.

6. PAYMENT METHODS

Payments are processed securely through PayTR, our authorized payment gateway. We utilize the 3D Secure authentication system to ensure the highest level of safety for every transaction. We accept the following payment methods:

  • Visa, Mastercard, American Express, and Troy. All financial data is fully encrypted and handled directly by the payment provider; Burky Swim does not store, see, or process your credit card information.

 

7. SHIPPING AND DELIVERY

  • Carrier: Orders to the United States (USA), the European Union (EU), and the United Kingdom (UK) are shipped via Worldwide Express Shipping through our international logistics partners.

  • Shipping Fees & Estimated Delivery: Product prices do not include shipping. The applicable shipping fee is calculated according to the delivery destination and added to the order total at checkout before payment. The estimated delivery time for orders to the USA, EU, and UK is 3-7 business days.

  • Tracking & Delays: A tracking number will be provided once your order has been dispatched. Delivery times are estimates and may be affected by carrier operations, destination-specific procedures, customs inspections, public holidays, or other circumstances outside Burky Swim's reasonable control. The risk of loss passes to the Buyer upon delivery of the goods to the carrier.

 

8. RETURN AND REFUND POLICY

Due to the intimate nature of swimwear and strict international health regulations, Burky Swim enforces an uncompromising return policy to ensure the hygiene and safety of all customers. By completing your purchase, you explicitly agree to the following terms:

  • Return Window & Authorization: Return requests must be initiated within 14 days of the delivery date. No returns will be accepted without prior written authorization from our support team. You must contact us at info@burkyswim.com to receive return instructions. Unauthorized returns will be strictly refused and returned to the sender at the Buyer's expense.

  • Strict Hygiene Standards: To be eligible for a return, the product must be unworn, unwashed, and in its original, untampered condition. The original packaging must be included. Most importantly, the protective hygiene liner (sticker) on the crotch area must remain perfectly intact and securely attached to the garment.

  • Rigorous Inspection & Voiding the Return: All returned items are subject to a rigorous inspection process upon arrival. If the adhesive seal of the packaging is compromised, if the hygiene liner has been removed, repositioned, or tampered with, or if the item shows any signs of wear, scent, marks, or washing, the return will be legally voided. The item will be shipped back to the Buyer at their own expense, and absolutely no refund will be issued.

  • Return Shipping & Customs Liability: All return shipping logistics, carrier arrangements, and costs are the sole responsibility of the Buyer. Furthermore, any customs duties, taxes, or import clearance fees incurred by Burky Swim when a returned package re-enters Turkey will be directly deducted from the Buyer's final refund amount.

  • Non-Refundable Costs: Original shipping fees paid at checkout and any import duties/taxes prepaid by Burky Swim for DDP (Delivered Duty Paid) shipments are strictly non-refundable for any "change of mind" or sizing returns.

  • Defective or Incorrect Items: Claims for manufacturing defects or incorrect items must be reported to us within 48 hours of delivery, accompanied by clear photographic evidence. If a defect is verified, Burky Swim will provide a replacement or a full refund, and we will cover the necessary return shipping costs. Claims made after the 48-hour window will not be accepted.

 

9. INTELLECTUAL PROPERTY

All content, including designs, logos (including the BURKY trademark), and imagery, is the exclusive property of Burky Swim. Unauthorized use is prohibited.

 

10. LIMITATION OF LIABILITY

Burky Swim shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or the inability to use the Site. Our maximum liability shall not exceed the amount paid by the customer for the specific product in question.

11. PRIVACY

Your personal information is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

12. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Turkey. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bursa, Turkey.

13. MODIFICATIONS

We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the Site following any changes constitutes acceptance of the new Terms.
